Terms of use

 

1. The parties to the agreement

 

This Agreement applies to licence holder (later Customer) and the service provider is Pub Entertainment with Smile (later Service Provider) Business ID: FI20958259. The contract customer means the company or organization to use service provider services. This includes using the entertainment software from Service provider. 

 

2. Duration of agreement

 

The licence is valid for the period specified in accordance with the order confirmation or while the service is in use by. The service includes entertainment software, printable marketing materials, instructions, training, customer support, and the game contents.

 

 

3. Responsibilities 

 

Service provider responsibilities: customer service, usernames & passwords and training. Service provider is also responsible for the maintenance, and contents of the software. Service provider is NOT responsible for the implementation of the customers events or hosts.

 

Customer responsibilities: Customer is responsible for marketing, hosts and arraging the events. The customer is responsible for the internal information, prizes and testing the software before the events. The customer is responsible for the operation of its own technology in the events (sound system and TV`s or screens). Customer is responsible of having the permits for playing the music in the events. 

 

 

4. Customer register

 

Service provider can collect customer register. Part of the data is e-mail, phone and other contact information. Customer can get the collected data. The collected customer data can also be used service providers own use. we reserves he right to use the acquired customer database.

 

 

5. The authorized use of the service

 

Service providers downloadable content to the software is only for the license holders (customer) use. Content and the software can only be used by one customer what is agreed in the order confirmation. All other use of the content and software is strictly prohibited. Content may not be transferred under any circumstances to a 3rd party without service provider approval. The service usernames and passwords are confidential. Abuse of the service, will lead to compensation for damages to a minimum of 10,000€. For example, an abuse can be considered as the presentation of the content more than one licence holder. Content copying or transmission of content to a3rd Party without service provider approval is prohibited.

 

6. Licence cancelling fees and refunds

 

If the licence is cancelled before the ending date and the service is payed full in advance, the service provider will refund 50% of the remaining licence fees. If the the licence is payed once a month the license fees are not refunded for that month but the order will end in the end of the month. 

 

 

7. Secrecy and confidentiality

 

All information contained herein is confidential and may not be transferred 3 parties.

 

 8. Law and juristiction

 

This Licence, its subject matter or its formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with Finnish law and submitted to the non-exclusive jurisdiction of the Finnish courts.
